Backscreen Photo Contest Privacy Notice

1. Data controller

Backscreen is the data controller for the personal data processed in connection with the contest.

2. Categories of personal data

Depending on how you participate, we may process the following categories of personal data:

• your name, surname, username, or social media profile name;
• your contact details, such as phone number, email address, or social media account details;
• your submitted photo(s);
• any personal data visible in the submitted photo(s), including images of identifiable persons;
• messages and correspondence related to the contest;
• information related to winner selection, announcement, and prize delivery or collection.

3. Sources of Personal Data

We collect personal data:

• directly from you when you submit a photo or contact us;
• from the content you provide, including photographs and messages;
• in some cases, from publicly visible information on your social media profile, where relevant to your submission.

4. Purposes and Legal Basis of Processing

We process personal data for the following purposes:

a) Contest administration

This includes receiving entries, reviewing submissions, contacting participants, selecting winners, and organizing the award process.

Legal basis: performance of a contract, i.e. administration of the contest under the applicable contest terms, and steps taken at your request before participation.

b) Publication of selected photos and contest communication

This includes publishing selected photos on Backscreen’s website, LinkedIn profile, and other Backscreen communication channels specified in the contest materials, as well as announcing winners.

Legal basis:

• your consent, where required under applicable law; and/or
• our legitimate interest in promoting the contest and Backscreen’s activities, provided that such interest is not overridden by the rights and freedoms of the persons concerned.

c) Compliance with legal obligations and protection of legal claims

This includes compliance with accounting, tax, regulatory, or other legal obligations, and handling legal claims or disputes.

Legal basis: legal obligation and/or our legitimate interest in establishing, exercising, or defending legal claims.

5. Photos containing other people

If you submit a photo that contains identifiable persons other than yourself, you are responsible for ensuring that you are allowed to share that photo with us and that the photo may be used as described in the contest terms.

Where required by applicable law, you must ensure that the relevant persons have been informed and have given any necessary permission or consent.

Please do not submit photos:

• containing children, unless you are legally entitled to do so and all required permissions have been obtained;
• containing sensitive, private, or confidential information;
• that may infringe the privacy, personality, copyright, or other rights of third parties.

6. Recipients of Personal Data

Your personal data may be shared with:

• Backscreen employees or authorized persons involved in contest administration;
• IT, hosting, website, and communication service providers;
• social media and messaging platform providers if you submit a photo via or if we publish content on such platforms, including WhatsApp, LinkedIn, Messenger, Instagram, Signal, and Telegram;
• event organizers or delivery service providers, where necessary for prize administration;
• public audiences, where selected photos or winner information are published online or announced publicly.

Some third-party platforms may process personal data under their own privacy policies and as independent controllers.

7. International data transfers

If you use social media or messaging platforms to submit photos, or if we publish photos on such platforms, personal data may be transferred outside the European Union or the European Economic Area by those platform providers in accordance with their own data processing arrangements.

We encourage you to review the privacy notices of the relevant platform providers before submitting your photo.

8. Retention Periods

Unless a longer retention period is required by law:

• non-selected submissions will be kept for 1 month after the end of the contest;
• selected photos and related publication data will be kept for 24 months after the end of the contest;
• winner and prize-related information will be kept for as long as necessary to administer the prize and comply with applicable legal obligations.

If a photo has been published online, removal from Backscreen-controlled channels will not affect prior sharing, screenshots, reposts, caching, or archiving by third parties.

9. Data Subject Rights

Subject to applicable law, you may have the right to:

• request access to your personal data;
• request correction of inaccurate or incomplete personal data;
• request deletion of your personal data;
• request restriction of processing;
• object to processing based on legitimate interests;
• withdraw your consent at any time, where processing is based on consent;
• lodge a complaint with the competent data protection supervisory authority.
